2. General instructions

This privacy policy explains the nature, scope and purpose of the processing of personal data when visiting our website and when contacting us.

3. Hosting and server log files

The website is provided through Vercel Inc., 440 N Barranca Ave #4133, Covina, CA 91723, USA. When accessing the website, technically necessary information such as IP address, time of access, browser information, operating system, referrer URL and requested resource can be processed.

The processing serves the secure, stable and efficient provision of the website. The legal basis is Art. 6 para. 1 lit. f GDPR. Our legitimate interest lies in the safe and trouble-free operation of our online offer. Processing in the USA cannot be excluded. Third-country transfers may only be made on the basis of type. 44 ff. DSGVO and the applicable contractual guarantees.

4. SSL/TLS encryption

The transmission between your device and our website is basically encrypted. An encrypted connection can be recognized in particular by the HTTPS address of your browser.

5. Email communication via IONOS

For our business e-mail communication and the post office info@no1pool.de we use services of IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany. In particular, sender and recipient addresses, times, subject lines, message contents, attachments and technical delivery information are processed.

The processing takes place for the processing of inquiries and for the implementation of pre-contractual measures according to art. 6 par. 1 lit. b GDPR and, where necessary, on the basis of our legitimate interest in secure and traceable business communication according to art. 6 par. 1 lit. f GDPR.

6. Contact Forms, Configurator and Resend

If you contact us via the contact form or the pool configurator, we will process the information you have entered to process your request, provide advice and prepare a possible offer. Depending on the form, this can be in particular name, company, address or project location, country, e-mail address, telephone number, product area, budget, configuration details and message content.

For the technical sending of the form data by e-mail we use Resend, a service of Plus Five Five, Inc., 2261 Market Street #5039, San Francisco, CA 94114, USA. In particular, Resend processes e-mail addresses, metadata and news content on our behalf. The processing is carried out according to art. 6 par. 1 lit. b GDPR. For transfers to the USA, the Resend Data Processing Addendum provides, among other things, the standard contractual clauses of the European Commission.

The request sent via Resend is delivered to our IONOS mailbox and processed there in accordance with the storage rules applicable to the request. After the Resend DPA, customer data will be deleted within 90 days after termination of the Resend contract, unless there are any legal reasons to the contrary.

7. Possible transfer to the manufacturer in Serbia

The sending of a form initially transmits your information exclusively to No1Pool.de. An automatic transmission of form data to the manufacturer does not take place.

Where information is required for the preparation of tenders, technical clarification or project coordination, a subsequent transfer to NO. 1 POOL D.O.O., Karadjordjeva 40, 22300 Stara Pazova, Serbia may be provided. Serbia is outside the European Economic Area and currently does not have an adequacy decision from the European Commission.

A transfer takes place only if the conditions of the species. 44 ff. DSGVO are fulfilled. Insofar as there are no suitable guarantees, in particular effective standard contractual clauses, and the transmission is exceptionally based on an express consent in accordance with art. 49, par. 1 lit. a DSGVO, we inform you in advance separately about the possible risks and obtain your express consent.

8. WhatsApp Business

Contact via WhatsApp is voluntary. Provider for users in the European Economic Area is WhatsApp Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland. In particular, mobile radio number, profile details, message contents, attachments and communication and metadata can be processed.

Alternatively, please use email or the contact form if you do not want to communicate via WhatsApp. For independent processing by WhatsApp or Meta, their data protection provisions apply.

9. Facebook and Instagram

We maintain presences on Facebook and Instagram. When visiting these platforms, data is also processed by Meta Platforms Ireland Limited. Depending on the specific processing, there may be a shared responsibility.

We process messages and interactions for communication, processing requests and presenting our company on the basis of art. 6 par. 1 lit. b or f DSGVO.

11. Google Tag Manager, Google Analytics 4 and Meta Pixel

We use the Google Tag Manager of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland, as a technical administration interface for website tags. The Google Consent signals are first set to “rejected”. Consent-dependent analytics and marketing tags may only be activated according to your selection in consent management.

Google Analytics 4 serves after your consent for the statistical evaluation of website use. The Meta Pixel of Meta Platforms Ireland Limited is used, upon your consent, to measure campaigns and create target groups for advertising on Meta Platforms. The legal basis is § 25 Abs. 1 TDDDG for access to your device and type. 6 par. 1 lit. a DSGVO for the subsequent processing.

When using these providers, data processing may take place outside the European Economic Area. Further information on providers, purposes, technologies used, recipients and storage periods is displayed in the Usercentrics dialog on a service-related basis. Consents can be revoked at any time with effect for the future.

12. Recipients and categories of recipients

13. Storage time

Personal data will be deleted or anonymized as soon as the processing purpose ceases and no statutory storage obligations or legitimate proof and defence interests conflict.

Inquiries that do not lead to a contract are generally deleted at the latest after the expiry of the regular civil limitation period, provided that an earlier deletion is possible and there are no open processes. Contractual and tax-relevant documents are stored in accordance with the applicable legal retention periods. Evidence of consent shall be retained for as long as is necessary to demonstrate proper consent.

14. Mandatory information in forms

Information marked as mandatory fields is necessary so that we can assign, answer and process the request in advance. Without this information, the request cannot be sent via the respective form or processed meaningfully. All information not marked as mandatory field is voluntary.

16. Right of appeal

You have the right to complain to a data protection supervisory authority. For No1Pool.de, the state commissioner is in particular responsible for data protection and freedom of information in Baden-Württemberg. Alternatively, you can contact the supervisory authority of your habitual residence, workplace or place of suspected infringement.

17. Automated decisions

An exclusively automated decision-making, including profiling in the sense of art. 22 GDPR does not take place when processing contact and project requests.
